 B. Modifications to terms of use and/or privacy policy

It is your responsibility to review the Terms of Use for any changes and you are encouraged to check the Terms of Use frequently. Your use of the Website following any amendment of the Terms of Use will signify your consent to and acceptance of any revised Terms of Use. If you do not agree to abide by these or any future Terms of Use, please do not use or access the Website

 C. Description of Service and Content Policy

In this section: - the legal responsibilities and liabilities of carsntrucks.ae are excluded or limited; - you take on risk, responsibilities and liability; and - any rights you have against carsntrucks.ae are limited or excluded. You must read these statements carefully and ensure they are correct, as you will not be able to deny the truth of the statements. carsntrucks.ae and/or other persons may have claims and other rights against you as a result of these statements.

Although you may be able to conduct payment and other transactions through the Website, using third-party vendors, carsntrucks.ae is not in any way involved in such transactions. As a result, and as discussed in more detail in these Terms, you hereby acknowledge and agree that carsntrucks.ae is not a party to such transactions, has no control over any element of such transactions, and, as far as the law allows, shall have no liability towards any party in connection with such transactions. As far as the law allows, you use the Service and the Website at your sole risk and responsibility.

   You understand that carsntrucks.ae is not responsible for ads, directory information, business listings/information, messages between users, including without limitation e-mails or chats or other means of electronic communication, whether through the Website or another Third Party Website (defined below) or offerings, comments, user postings, files, images, photos, video, sounds, business listings/information and directory information or any other material made available through the Website and the Service ("Content"), and that by using the Website and the Service, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. As far as the law allows, you are responsible for and must evaluate, and bear all risks associated with, the use of any Content. You may not rely on said Content, and under no circumstances will carsntrucks.ae be liable in any way for the Content or for any loss or damage of any kind incurred as a result of the browsing, using or reading any Content listed, e-mailed or otherwise made available via the Service.

• carsntrucks.ae is not obliged to pre-screen or approve any Content, but carsntrucks.ae has the right, in its sole and absolute discretion, to refuse, delete or move any Content that is or may be available through the Service, for violating these Terms and such violation being brought to carsntrucks.ae knowledge or for any other reason or no reason at all. Furthermore, the Website and Content available through the Website may contain links to other third party websites ("Third Party Websites"), which are completely unrelated to carsntrucks.ae. If you link to Third Party Websites, you may be subject to those Third Party Websites’ terms and conditions and other policies. As far as the law allows, carsntrucks.ae makes no representation or guarantee as to the accuracy or authenticity of the information contained in any such Third Party Websites, and your linking to any other websites is, as far as the law allows, completely at your own risk and carsntrucks.ae disclaims all liability thereto.

   You are solely responsible for your own Content posted on, transmitted through, or linked from the Service and the consequences of posting, transmitting, linking or publishing it. More specifically, you are solely responsible for all Content that you upload, email or otherwise make available via the Service. In connection with such Content posted on, transmitted through, or linked from the Service by you, you affirm, acknowledge, represent, warrant and covenant that:

For clarity, you retain all of your ownership rights in your Content; however, by submitting any Content on the Website, you hereby grant to carsntrucks.ae an irrevocable, non-cancellable, perpetual, worldwide, non-exclusive, royalty-free, sub-licensable, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Website and carsntrucks.ae (and its successors') business, including without limitation for the purpose of promoting and redistributing part or all of the Website and Content therein (and derivative works thereof) in any media formats and through any media channels now or hereafter known. These rights are required by carsntrucks.ae in order to host and display your Content. Furthermore, by you posting Content to any public area of the Service, you agree to and do hereby grant to carsntrucks.ae all rights necessary to prohibit or allow any subsequent aggregation, display, copying, duplication, reproduction, or exploitation of the Content on the Service or Website by any party for any purpose which contravenes these Terms. These rights are perpetual and cannot be revoked by you and will apply and can be exercised throughout the world. You also hereby grant each user of the Website a non-exclusive license to access your Content through the Website (this license excludes automated data collection/scraping cases and any other possible use with commercial purposes). The foregoing license to each user granted by you terminates once you or carsntrucks.ae remove or delete such Content from the Website.

D. Member Conduct

1. Prohibitions on submitted content.

• You shall not upload, post, transmit, transfer, disseminate, distribute, or facilitate distribution of any content, including text, images, video, sound, data, information, or software, to any part of the Website, including your profile ("Profile"), the posting of your Service ("Offer"), the posting of your desired Service ("Want"), or the posting of any opinions or reviews in connection with the Website, the Service, the Service Professional, or the Service User ("Feedback") (all of the foregoing content is sometimes collectively referred to herein as "Submitted Content" and the posting of Submitted Content is sometimes referred to as a "Posting" or as "Postings") that:

   misrepresents the source of anything you post, including impersonation of another individual or entity or any false or inaccurate biographical information for any Service Professionals; provides or create links to external sites that violate the Terms of Use; is intended to harm or exploit any individual under the age of 18 ("Minor") in any way; is designed to solicit, or collect personally identifiable information of any Minor, including, but not limited to, name, email address, home address, phone number, or the name of his or her school;

invades anyone's privacy by attempting to harvest, collect, store, or publish private or personally identifiable information, such as names, email addresses, phone numbers, passwords, account information, credit card numbers, home addresses, or other contact information without their knowledge and willing consent;

• contains falsehoods or misrepresentations that could damage carsntrucks.ae or any third party;

is pornographic, harassing, hateful, illegal, obscene, defamatory, libelous, slanderous, threatening, discriminatory, racially, culturally or ethnically offensive; incites, advocates, or expresses pornography, obscenity, vulgarity, profanity, hatred, bigotry, racism, or gratuitous violence; encourages conduct that would be considered a criminal offense, give rise to civil liability or violate any law; promotes racism, hatred or physical harm of any kind against any group or individual; contains nudity, violence or inappropriate subject matter; or is otherwise inappropriate;

• is copyrighted, protected by trade secret or otherwise subject to third-party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from the rightful owner to post the material and to grant carsntrucks.ae all of the license rights granted herein;

contains or promotes an illegal or unauthorized copy of another person's copyrighted work, such as pirated computer programs or links to them, information to circumvent manufacture installed copy-protection devices, pirated music or links to pirated music files, or lyrics, guitar tabs or sheet music, works of art, teaching tools, or any other item the copy, display, use, performance, or distribution of which infringes on another's copyright, intellectual property right, or any other proprietary right;

• is intended to threaten, stalk, defame, defraud, degrade, victimize, or intimidate an individual or group of individuals for any reason on the basis of age, gender, disability, ethnicity, sexual orientation, race, or religion; or to incite or encourage anyone else to do so;

intends to harm or disrupt another user's computer or would allow others to illegally access software or bypass security on websites or servers, including but not limited, to spamming; impersonates, uses the identity of, or attempts to impersonate a carsntrucks.ae employee, agent, manager, host, another user, or any other person though any means;

• advertises or solicits a business not related to or appropriate for the Website (as determined by carsntrucks.ae in its sole discretion);

contains or could be considered "junk mail", "spam", "chain letters", "pyramid schemes", "affiliate marketing", or unsolicited commercial advertisement;

• contains advertising for ponzi schemes, discount cards, credit counseling, online surveys or online contests;

distributes or contains viruses or any other technologies that may harm carsntrucks.ae, or the interests or property of carsntrucks.ae users

• contains links to commercial services or websites, except as allowed pursuant to the Terms of Use;is non-local or irrelevant content;

contains identical content to other open Postings you have already posted; or uses any form of automated device or computer program that enables the submission of Postings without the express written consent of carsntrucks.ae

2. Prohibitions on sending messages

• You will not send messages to other users containing:

offers to make national or international money transfers for amounts exceeding or decreasing the asking price of a service, with intent to request a refund of any portion of the payment; orunsolicited advertising or marketing of a service not offered on the Website or an external website.

3. No Discrimination

• Discriminatory Postings. United Arab Emirates’ laws prohibit any preference, limitation or discrimination based on race, color, religion, sex, enthnic origin, age, caste, doctrine, handicap or other protected class. carsntrucks.ae will not knowingly accept any Posting which is in violation of the law. carsntrucks.ae has the right, in its sole discretion and without prior notice to you; to immediately remove any posting that discriminates or is any way in violation of any law.

4. Prohibitions with respect to services.

• While using the Website, you shall not:

post content or items in any inappropriate category or areas on the Website;violate any laws, third-party rights, Account Policies, or any provision of the Terms of Use, such as the prohibitions described above;

fail to deliver payment for Services purchased by you, unless the Service Professional has materially changed the description of the Service description after you negotiate an agreement for such Service, a clear typographical error is made, or you cannot authenticate the Service Professional's identity;

fail to perform Services purchased from you, unless the Service User fails to materially meet the terms of the mutually agreed upon agreement for the Services, refuses to pay, a clear typographical error is made, or you cannot authenticate the Service User's identity; manipulate the price of any Service or interfere with other users' Postings;

circumvent or manipulate our fee structure, the billing process, or fees owed to carsntrucks.ae; post false, inaccurate, misleading, defamatory, or libelous content (including personal information about any Website user);

take any action that may undermine the Feedback or ratings systems (such as displaying, importing or exporting Feedback information off of the Website or using it for purposes unrelated to the Website);

E. Featured Ads

carsntrucks.ae offers a service known as "Featured Ads" where users may pay a non-refundable fee to have their ads posted in selected locations on the Website, thus potentially increasing an ads' visibility. In order to purchase a Featured Ad, you may be required to transmit certain information through a third party service provider, that may be governed by its own terms of use and other policies. carsntrucks.ae makes no representation or guarantee as to the safety or security of the information transmitted to any Third Party Website, and your linking to any Third Party Website is completely at your own risk, and carsntrucks.ae disclaims all liability related thereto.

F. Paid Postings

carsntrucks.ae may charge a fee to post Content in some specific areas of the Service (Paid Content). The fee permits Paid Content to be posted in a designated area of the Website. Each party posting Paid Content to the Service is responsible for the Content and compliance with the Terms. Any such fees paid hereunder are non-refundable in the event any Content is removed from the Service for violating these Terms. Additional terms regarding Paid Content will be fully stated in the applicable section(s).

G.Posting Agents

As used herein, the term "Posting Agent" refers to a third-party agent, service or intermediary that offers to post Content to the Service on behalf of others. carsntrucks.ae prohibits the use of Posting Agents, directly or indirectly, without the express written permission of carsntrucks.ae. In addition, Posting Agents are not permitted to post Content on behalf of others, directly or indirectly, or otherwise access the Service in order to post Content on behalf of others, except with express written permission or license from carsntrucks.ae.

H. Access to the Service

This Website is intended only for adults and you warrant that you are eligible to contract as per applicable laws. If you are using/accessing this Website as a representative of any person/entity, you acknowledge that you are legally authorized to represent that person/entity. Minors are only allowed to access the Website and use the Service, in the event of approval of their legal representatives or in the event that it concerns an act or a transaction that is usual and acceptable standard in civil life and practice. You affirm that you are either at least 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.

carsntrucks.ae grants you a limited, revocable, non-exclusive license to access and use the Service for personal use. This license granted herein does not include any of the following: (a) access to or use of the Service by Posting Agents; or (b) any collection, aggregation, copying, duplication, display or derivative use of the Service nor any use of data mining, robots, spiders, or similar data gathering and extraction tools for any purpose unless expressly permitted by carsntrucks.ae or as otherwise set forth in these Terms. Notwithstanding the foregoing, general purpose internet search engines and non-commercial public archives that gather information for the sole purpose of displaying hyperlinks to the Service, provided they each do so from a stable IP address or range of IP addresses using an easily identifiable agent and comply with our robots.txt file, may engage in the activities set forth in (b). For purposes of this exception, a "general purpose internet search engine" does not include a website or search engine or other service that specializes in classified listings including any subset of classifieds listings such as housing, for sale, jobs, services, or personals, or which otherwise provides classified ad listing services. The license set forth in this Section permits you to display on your website, or create a hyperlink thereto, individual postings on the Service so long as such use is for non-commercial and/or news reporting purposes only (e.g., for use in personal blogs or other personal online media). carsntrucks.ae may limit the amount of postings displayed on or linked to your website. Use of the Service beyond the scope of authorized access as set forth in these Terms immediately terminates any permission or license granted herein. In order to collect, aggregate, copy, duplicate, display or make derivative use of the Service or any Content made available via the Service for other purposes (including commercial purposes) not stated herein, you must first obtain a license from carsntrucks.ae.

I. Notification of Claims of Infringements

If you are an owner of intellectual property rights or an agent who is fully authorised to act on behalf of the owner of intellectual property rights and believe that any Content or other content infringes upon your intellectual property right or intellectual property right of the owner on whose behalf you are authorised to act, you may submit a notification to help@carsntrucks.ae together with a request to carsntrucks.ae to delete the relevant Content in good faith. The notification and the request must contain the following information:

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

Identification of the intellectual property rights claimed to have been infringed, or, if multiple intellectual property rights at a single online site are covered by a single notification, a representative list of such works at that site;

Identification of the Content (by means of data or communication link, etc.) that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit carsntrucks.ae to locate the material;

Information reasonably sufficient to permit carsntrucks.ae to contact you, such as an address, telephone number, and an electronic mail address;

1. carsntrucks.ae owns or holds the license to all data and marks on the website

The content on the Website (exclusive of all Submitted Content), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Data") and the trademarks, service marks and logos contained therein ("Marks"), are owned by carsntrucks.ae. Other trademarks, names and logos on this Website are the property of their respective owners.

Data on the Website is provided to you AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. carsntrucks.ae reserves all rights not expressly granted in and to the Website and the Data. You agree not to use, copy, or distribute, any of the Data other than as expressly permitted herein, including any use, copying, or distribution of Submitted Content obtained through the Website for any commercial purposes. If you download or print a copy of the Data for personal use, you must retain all copyright and other proprietary notices contained thereon. You agree not to circumvent, disable or otherwise interfere with security features of the Website or features that prevent or restrict use or copying of any Data or enforce limitations on use of the Website or the Data therein.

2. carsntrucks.ae license to you for the use of Data and Marks.

The Website contains carsntrucks.ae's Data and Marks, which are, or may become, protected by copyright, trademark, patent, trade secret and other laws, and carsntrucks.ae owns and retains all rights in the carsntrucks.ae Data and Marks. Subject to these Terms of Use, carsntrucks.ae hereby grants you a limited, revocable, nontransferable, nonsublicensable license to reproduce and display the carsntrucks.ae Data (excluding any software source code) solely for your personal use in connection with accessing and participating in the Website.

The Website may also contain Data of other users or licensors, which you shall not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell.

carsntrucks.ae may provide a translation of the English version of the Terms into other languages. Any translation of the Terms into other languages is for your convenience only and the English version governs the terms of your relationship with carsntrucks.ae. Furthermore, if there are any inconsistencies between the English version of the Terms and any translation, the English version of the Terms shall prevail.

K. Disputes between registered users

Subject to the provisions regarding disputes between Website participants in connection with Feedback, your interactions with individuals and/or organizations found on or through the Website, including payment of and performance of any Service, and any other terms, conditions, warranties or representations associated with such transactions or dealings, are solely between you and such individual or organization. You should take reasonable precautions and make whatever investigation or inquiries you deem necessary or appropriate before proceeding with any online or offline transaction with any third party, including without limitation, service professionals and Service Users.

You understand that deciding whether to connect to a registered users or use information contained in any Submitted Content, including, without limitation, Postings, Offers, Wants and/or Feedback, is your personal decision for which alone are responsible. You understand that carsntrucks.ae does not warrant and cannot make representations as to the suitability of any individual / institution. you may decide to interact with on or through the Website and/or the accuracy or suitability of any advice, information, or recommendations made by any individual. While carsntrucks.ae may attempt to seek information about the background of a registered user, either via a telephonic, official way of communication, on Facebook, personalised website, LinkedIn, Twitter etc.,  You also understand that any so called background check undertaken by carsntrucks.ae is not exhaustive to the extent to determine previous criminal antecedents and hence, at the end of the day, the Service User should take an informed decision on his/her own accord and keep in mind the fact that carsntrucks.ae only seeks to provide a platform wherein registered users and Service Professionals have an opportunity to meet each other.

You agree that since carsntrucks.ae only seeks to provide a platform wherein the registered users, Service User and Service Professional can be brought together and carsntrucks.ae itself has no role in the execution or provision of Services. carsntrucks.ae shall not be responsible or liable for any loss, fraud, Damage etc.. whether direct or indirect dealings. any dispute arised between registered users / users or third party, you acknowledge and agree that carsntrucks.ae is under no obligation to be involved. also, you hereby release carsntrucks.ae, Directors, Officers, Managers, Members, Employees, Attorneys Agents, and successors in rights of any claims, demands or damages. (actual or Consequential) of every nature known or unknown, suspected or unsuspected, disclosed or undisclosed, arasing out of or in any way related to such disputes and/or the website or any services provided thereunder.

L. User Submissions

The legal responsibilities and liability of carsntrucks.ae are limited or excluded; - the rights or remedies you may have against carsntrucks.ae are limited or excluded; and - you take on risk, responsibilities and liability. You accept that various things can go wrong when using the Website and/or the Service, and/or when viewing and/or using the Content. You take on the responsibility and liability of these events happening and will have no claim against carsntrucks.ae if they happen. When using the Website, you will be exposed to Content from a variety of sources, and that, as far as the law allows, carsntrucks.ae is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Content, and you agree and assume all liability for your use. You further may be exposed to Content that is inaccurate, offensive, indecent, objectionable, defamatory or libelous and, as far as the law allows, you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against carsntrucks.ae with respect thereto.

M. Indemnity

The legal responsibilities and liability of carsntrucks.ae are limited or excluded; - the rights or remedies you may have against carsntrucks.ae are limited or excluded; and - you take on risk, responsibilities and liability. - you indemnify carsntrucks.ae and other persons against liability and claims. As far as the law allows, you agree to defend, indemnify and hold harmless carsntrucks.ae, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, from and against any and all claims, damages, obligations, losses (whether direct, indirect or consequential),, liabilities, costs or debt, and expenses (including but not limited to attorneys' fees) arising from: (i) your violation of any provision of these Terms; (ii) your violation of any third party right, including without limitation any copyright, trademark, trade secret or other property, or privacy right; or (iii) any claim that your Content caused damage to a third party. As far as the law allows, this defence and indemnification obligation will survive termination, modification or expiration of these Terms and your use of the Service and the Website.

N. No Spam Policy

You take on risk, responsibilities and liability. This may result in you being punished under applicable criminal laws, and/or you becoming financially liable to carsntrucks.ae and/or other persons for additional amounts. You understand and agree that sending unsolicited email advertisements or other unsolicited communications to carsntrucks.ae email addresses or through carsntrucks.ae computer systems are expressly prohibited by these Terms. You acknowledge and agree that from time to time carsntrucks.ae may monitor email usage using human monitors or automated software to flag certain words associated with spam or scams in emails that are sent between one users to another in the carsntrucks.ae e-mail system. Any communication between yourself and any other user utilizing the communication features available on the Service and the Website may be used only in accordance with the Terms. Any unauthorized use of carsntrucks.ae computer systems is a violation of these Terms and certain applicable laws, in particular the UAE Cybercrimes legislation. Such violations may subject the sender and his or her agents to civil and criminal penalties. Please note that the UAE Cybercrimes legislation carries significant penalties including imprisonment. In case you intend to solicit, or contact our users by obtaining their email or phone numbers from our Website, we may report this behavior to the relevant authorities, who then may decide to prosecute you under the relevant UAE laws.

O. Dealings with Organizations and Individuals

The legal responsibilities and liability of carsntrucks.ae are limited or excluded; - the rights or remedies you may have against carsntrucks.ae are limited or excluded; and - you take on risk, responsibilities and liability. As far as the law allows,  carsntrucks.ae shall not be liable for your interactions with any organizations and/or individuals on the Website or through the Service. This includes, but is not limited to, payment and delivery of goods and services, and any other terms, conditions, warranties or representations associated with any interaction you may have with other organizations and/or individuals. These dealings are solely between you and such organizations and/or individuals. As far as the law allows, carsntrucks.ae shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or interactions. In the event that you have a dispute with one or more other users, as far as the law allows, you hereby release carsntrucks.ae, it's Directors, Officers, Managers, Members, Employees, Attorneys Agents, and successors in rights of any and all claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or our Service.

P. Limitation and Termination of Service
